MicroScan License Agreement

This is a legal agreement between you, the end user, and Intech Instruments Limited.  BY OPENING THE SEALED DISK PACKAGE OR INSTALLING AND USING THE SOFTWARE, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT.  IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, PROMPTLY RETURN THE DISK PACKAGE AND THE ACCOMPANYING ITEMS (including written materials and software dongle) TO THE PLACE YOU OBTAINED THEM FOR A FULL REFUND.

 1                COPYRIGHT

The SOFTWARE is owned by Intech Instruments Limited or its suppliers and is protected by New Zealand copyright laws and all other applicable national laws.  Therefore, you must treat the SOFTWARE like any other copyrighted material (eg, a book) and you may not copy the product manuals or written materials accompanying the SOFTWARE.

 2                Information presented in this document is subject to change without notice in keeping with the Intech Instruments Limited commitment to further market development.

 3              The software included with this booklet is also a demonstration copy of the INTECH MICRO  SCADA Software with demonstration setup for the various utilities.  Feel free to copy this software and distribute it as you wish.  The software will only communicate with an outstation or PLC when software registered or a custom hardware dongle is present on the USB or printer port.  Hardware dongles are available upon purchase of the system.  You may not copy the hardware dongles. Manuals are included in electronic form in the installation.

 4              OTHER RESTRICTIONS

                You may not reverse engineer, decompile or disassemble the SOFTWARE.

 LIMITED WARRANTY

 To the full extent permitted by the laws applicable to this Agreement, any conditions or warranties imposed by such legislation are hereby excluded.  Insofar as liability under or pursuant to any legislation may not be excluded, such liability is limited to:

 i)              replacement of the SOFTWARE (and any accompanying hardware, if supplied by Intech Instruments Limited).

 ii)              corrections of defects in the SOFTWARE at the exclusive option of Intech Instruments Limited.

 You acknowledge that no promise, representation or warranty or undertaking has been made or given by Intech Instruments Limited or any person or company on its behalf in relation to the profitability of or any other consequences or benefits to be obtained from the delivery or use of the SOFTWARE and any accompanying Intech Instruments Limited supplied hardware, SOFTWARE manuals and written materials.

Except as, and to the extent that it is hereinbefore provided, under no circumstance shall Intech Instruments Limited or any related company be liable for any loss, damage or injury (including without limitation any loss of profit, indirect, consequential or incidental loss, damage or injury) arising from the supply or use of the SOFTWARE and any accompanying hardware and written materials or any failure by Intech Instruments Limited or any related company to perform any obligation or observe any terms of this Agreement.
